‘He was asked to leave the premises and walked away in the direction of Timoleague,’ said Gda Blake. ‘On arrival we patrolled the road but couldn’t locate him, but at 11.25pm we observed the accused walking towards the bar brandishing a metal baseball bat.

‘We told him to drop the weapon and he complied. I stopped the patrol car and he then retrieved a steak knife concealed on him and discarded it on the ground.’

Gda Blake said there was a strong smell of alcohol coming from the accused and he was arrested and conveyed to Bandon Garda Station.

No one who was in the bar at the time made a statement to gardaí about the accused’s behaviour on the night in question, the court heard.

Sgt Tom Mulcahy said the accused has 94 previous convictions for a wide range of offences including assault, public order, criminal damage and road traffic offences.

Defence solicitor Plunkett Taaffe said his client has a significant alcohol addiction and has been in custody since November 17th of last year having been unsuccessful in securing bail.

‘He was homeless before this and then moved to Courtmacsherry but he isn’t going back. He is engaging with the probation services,’ said Mr Taaffe.

Judge Carroll said that while alcohol is one of his issues he still went back to his house and got a knife and a baseball bat with the intention of using them. However, Mr Cummins said he had no intention of doing that.

The judge sentenced him to four months in prison backdated to the date when he was first taken into custody.
