A MAN arrested at a property in Kilmacsimon had refused four times to obey garda directions to leave the area.

Mariusz Malarz of 1 Connolly Road, Ballyphehane, Cork city pleaded guilty at Bandon District Court to refusing to obey garda direction.

Insp Kay O’Donoghue told Judge Joanne Carroll that on July 23rd 2024 Gda O’Reilly was on duty when the station received a call at 11.28pm regarding an incident at a property at The Moorings in Kilmacsimon.

‘A female at the house had rang 999 as her partner had become very aggressive to her and her family and her sick mum who was in the house,’ said Insp O’Donoghue.

‘When gardaí arrived they found her outside and visibly upset. She said the accused was drunk and shouting at her and her children.

‘While speaking to the accused he became very hostile and Gda O’Reilly suggested that he move away but he declined. The injured party went back into her house and he came back in and refused to leave when requested to do so.’

Mr Malarz told gardaí he wasn’t going to leave so they were unable to have a private conversation with the woman.

‘He continued to put her in fear and when asked again to leave he became very abusive to Gda O’Reilly.’

He was arrested as he had been asked four times by gardaí to stop and he declined. The court heard he has no previous convictions.

Defence solicitor Plunkett Taaffe said his client is Polish and works as a chef and has now ‘seen the light’.

Judge Carroll said she was concerned about his relationship with alcohol.

She adjourned the case to February 20th for a probation report.

She said she would need proof of attending anger management classes and alcohol addiction services as well as a letter from his employer.
