A plumber who had to be pepper sprayed after lashing out and striking a garda, and hurling profanities was jailed for three months.
Daniel McCarthy (27) of 12 Ardnamana, Cappagh, Kinsale was arrested after a night out, Bandon District Court heard recently.
He pleaded guilty to being drunk in a public place and using or engaging in threatening, abusive or insulting words or behaviour.

The court heard that the incidents arose at 12.30am on August 17th when Gda Cormac Dineen accompanied by Gda Padraig Walsh were flagged down by a doorman from Kitty Ó Sé’s Bar in Kinsale.
‘A drunk male had caused a physical disturbance outside and ran away. The gardaí went looking for the accused and when Gda Dineen was walking towards Newman’s Mall he heard shouting from a male,’ said Sgt Tom Mulcahy.
‘The accused tried to evade being caught and tried to run around Gda Dineen who reached out to stop him and grabbed him, but fell to the ground and suffered an injury to his elbow as a result.
‘He was eventually cautioned by Gda Dineen and was escorted to the patrol car where he calmed down a small bit. He was then placed in the rear of the car. As they were about to leave he started shouting and roaring and was frothing at the mouth.’
Sgt Mulcahy added that a small crowd had gathered at this stage and the accused took off his shirt and then attempted to get out of the car.
‘He lost control, struck one of the gardaí while Gda Walsh had to use his pepper spray on him. This had an immediate effect on him and he was placed in handcuffs.’
The court heard that a personnel carrier had to come from Bandon to transport him but when placed in the cell he continued to shout and roar and laid on the floor feigning injury.
‘On arrival at Bandon Garda Station he told Gda Dineen that he would make him pay and get him sacked in the morning. He remained aggressive and uncooperative throughout his detention. He was later charged with the offences and when handed his charge he crumpled it up and threw it on the floor.’
He told Gda Dineen that he was a ‘c**’ when leaving the station, the court heard.
The court heard that Mr McCarthy has 16 previous convictions which include assault, criminal damage, careless driving and public order offences.
In August 2022 he was convicted of assaulting two gardaí and the possession of a knife. The court heard on that occasion that he smeared his own blood on the wall of a garda cell.
Defence solicitor Éamonn Fleming said his client, who is a qualified plumber, has an ADHD condition and handed Judge Carroll a medical report on him. He said he needs medication for his ADHD and also has an alcohol addiction.
Judge Carroll sentenced him to three months in prison on the more serious of the public order charges and admitted him to a probation bond on the drunk in public charge for 18 months. During this period he must cooperate with the probation services, avail of addiction treatment and take all prescribed medication.
She also directed that the Governor of Cork Prison to get his ADHD diagnosis assessed and to ensure he is provided with the appropriate medicine.
‘You’ve got to get clean. The world is your oyster and you’re a qualified plumber and you need to deal with your ADHD,’ said Judge Carroll.
