Judge strikes out cases over missing fixed charge notices

AS the Garda Siochána revelations about fixed charged penalty notices continue, a number of motorists had their cases for speeding struck out a recent sitting of Bandon District Court.

Judge David Waters was told by a number of defendants that they did not receive the fixed charge notice requesting them to pay the fine.

Several other motorists who were also charged with speeding had their cases adjourned until April 7th.

Liam O’Reilly, 31 Ard Aoibhinn, Innishannon pleaded not guilty to the charge of speeding at Murragh, Enniskeane on April 15th 2016.

The court was told that he was detected doing 76km/h in a 60km/h zone and that a fixed charge notice was issued but had not been paid. Mr O’Reilly told Judge David Waters that his son was driving his car but that he’s now living in London and that the nomination form wasn’t received in time. Judge Waters struck out the case.

Edward Brennan, ‘Avondale’, Dunmanway Rd, Bandon appeared in court on a charge of doing 83km/h in a 60km/h zone at Murragh, Enniskeane on June 6th 2016.

The court was told that a fixed charge notice was issued but had not been paid. The defendant told the court that he never received the notice and that he had moved house to Kilbrittain that month. Judge Waters struck out the case.

John O’Riordan, Caherdaniel, Bantry appeared in court charged with doing 69km/h in a 60km/h zone at Murragh, Enniskeane on July 2nd2016.

The court was told that a fixed charge notice was issued but had not been paid. The defendant contested the charge and Judge Waters struck it out.

Michael Helen, Main Street, Ballydehob also appeared in court charged with doing 69km/h in a 60km/h zone at Murragh, Enniskeane on July 9th 2016.

The court was told that a fixed charge notice was issued but had not been paid. Giving evidence in court the defendant said he never received anything in the post and the first he had heard of it was when he received a summons from the gardaí.

Judge Waters struck out the case.

Eoghan O’Neill, 21 Ring Curran Rise, Ardbrack, Kinsale appeared in court charged with doing 107km/h in a 80km/h zone at Bawnleigh, Ballinhassig on July 14th 2016.

The court was told that a fixed charge notice was issued but had not been paid. Giving evidence in court the defendant said he didn’t receive the notice and that the car is registered to his home address. Judge Waters struck out the case.

Shane Behan, Barnahely, Ringaskiddy pleaded not guilty to the charge of speeding in Murragh on March 24th 2016.

The Go Safe operator told the court that the defendant was doing 71km/h in a 60km/h zone at Murragh, Enniskeane and that a fixed charge notice was issued but had not been paid. Mr Behan told Judge

Waters that he was driving a company car and he never received it. His case was adjourned until April 7th.

Ronan Lennon, Ardnacloghy, Ballylickey, Bantry pleaded not guilty to a charge of speeding on April 1st 2016.

Aidan Barry, a Go Safe operator told the court that the defendant was detected doing 72km/h in a 60km/h zone at Murragh, Enniskeane.

The court was told a fixed charge notice was issued but had not been paid. Mr Lennon told Judge Waters that he received the notice after 56 days when it was too late to pay and his case was adjourned until April 7th.

Kieran Daly, 7 Main St, Innishannon pleaded guilty to a charge of speeding on April 15th 2016 at Murragh, Enniskeane where he was detected doing 92km/h in 60km/h zone. The court was told that a fixed charge notice was issued but had not been paid and his case was adjourned until April 7th.

Aoife O’Mahony, Woodgate, The Doon, Dunderrow, Kinsale did not appear in court on a charge of speeding but her father appeared in her absence. However Judge Waters said he could not give evidence on her behalf.

The court was told that the defendant was detected doing 70km/h in a 60km/h zone at Murragh, Enniskeane on May 15th 2016.

A fixed charge notice was issued but had not paid and Judge Waters adjourned the case to April 7th in order for the defendant to attend court herself to give evidence.
